This is in regard to a Workers Compensation Fraud case that has been brought up against my father. In 1999, he was working as a porter for Temco, as well as a Superintendent for a Building Management company. He was injured on the job at Temco and declared partially disabled. His Workers Compensation case was handled by a law firm in Staten Island, NY. Only the law firm and my father had any knowledge of that case. As far as I know, he received payments for a short time, but those payments eventually stopped. There hadn’t been any further hearings in the last few years. The only time that we heard from them in the last few years was February 2010, when they asked for a copy of his 2007 Tax Statements, which were sent. He never returned back to Temco, but continued working for the Building Management Company as a Superintendent. In August 2009, while working for the Building Management firm he was once again injured on the job, and sustained a Traumatic Brain Injury. While he was at the hospital, my mother and I filed for Workers Compensation. In June of 2010, a week before the final hearing for the 2009 case, we received a notice for him to appear for a hearing regarding the 1999 case. Due to my fathers severe injury, I tried getting in contact with the attorney from the 1999 case, however I was told that he was not able to speak to me due to confidential laws. I tried explaining to him the situation, and wanted to update him on what had happened in 2009. At the 1999 hearing, Workers Compensation was notified that my father had another hearing in process, but never questioned anything. Both cases were settled a week apart, and he started receiving two separate checks, one for each case. At his last hearing in the 99 case, which was held on Sept. 15th, the mention of Fraud was brought up. The issues stated were that he was receiving checks for both cases, and Workers Compensation claims that they were unaware that he had returned back to work after his 1999 Temco case. I feel that we did everything that we were asked to do.
